
EVENT TICKET SALES

By purchasing, possessing, or using a ticket to any event, market, festival, activation, or activity operated by That’s Mine Events (“the Organiser”), you (“the Ticket Holder” or “Attendee”) agree to be legally bound by the following Terms & Conditions. These terms apply regardless of how the ticket was purchased or obtained (including complimentary tickets).
This agreement is enforceable under applicable Australian consumer and contract law.
1. TICKET SALES, REFUNDS & CANCELLATION POLICY
1.1 All Ticket Sales Are Final
1.1.1 Tickets are non-refundable, non-exchangeable, and non-transferable under all circumstances, except where required by law.
1.1.2 Change of mind, personal circumstances, illness, transport issues, or dissatisfaction with event operations do not constitute grounds for a refund.

1.2 No Refunds for Event Modifications
1.2.1 The Organiser reserves the right to alter, amend, or modify the Event program, layout, attractions, activities, stallholders, or schedule without notice.
1.2.2 No refunds or credits apply if any scheduled activity, ride, stallholder, performance, or element of the Event is changed, delayed, or unavailable.

1.3 Weather-Related Policies
1.3.1 Outdoor events proceed in a range of weather conditions.
1.3.2 No refunds apply due to rain, heat, wind, storms, adverse weather forecasts, or actual weather conditions.

1.4 Partial Closure or Early Closure
1.4.1 If the Event commences but is later impacted or forced to close early due to safety, weather, operational issues, or instructions from emergency services, no refunds, partial refunds, or credits apply.
1.4.2 Ticket Holders acknowledge this risk at the time of purchase.

1.5 Event Cancellation Before Opening
1.5.1 Only if the Event is fully cancelled before gates open, and no alternative date is offered, may refunds be considered at the Organiser’s discretion.

2. ENTRY, CONDUCT & CONDITIONS OF ATTENDANCE
2.1 Conditions of Entry
2.1.1 Entry is only granted upon presentation of a valid ticket.
2.1.2 The Organiser may refuse entry or remove any attendee who:

behaves in a dangerous, aggressive, disruptive, or offensive manner
-
fails to comply with staff instructions
-
breaches health or safety guidelines
-
appears intoxicated, impaired, or unfit for entry
No refund applies in these circumstances.

2.2 Compliance With Rules
2.2.1 Attendees must follow all signage, instructions, safety warnings, and directions issued by the Organiser, staff, volunteers, contractors, security, or emergency personnel.
2.2.2 Failure to comply may result in removal from the Event without refund.

3. ENTRY AT OWN RISK – LIABILITY WAIVER
3.1 Assumption of Risk
3.1.1 By attending the Event, the Ticket Holder acknowledges that participation in outdoor markets, festivals, rides, amusements, and community events carries inherent risks.
3.1.2 These risks include but are not limited to:
-
weather-related hazards
-
uneven surfaces
-
crowds and congestion
-
rides and mechanical equipment
-
animals, children, and moving objects
-
noise, lights, and activity-related risks

3.2 Waiver of Claims
To the fullest extent permitted by law:
3.2.1 The Ticket Holder waives all rights to sue or make claims against the Organiser for:

personal injury, illness, or death
-
loss, theft, or damage to personal property
-
financial loss or consequential loss
-
accidents, incidents, or hazards occurring at or arising from the Event
3.2.2 The Organiser, its employees, contractors, volunteers, partners, sponsors, suppliers, and venue owners accept no responsibility for any loss, damage, injury, or liability incurred by attendees.

3.3 Indemnity
3.3.1 The Ticket Holder agrees to indemnify and hold harmless the Organiser against any claim, damage, demand, loss, or expense arising from:

breach of these Terms
-
unsafe behaviour
-
misuse of facilities
-
failure to supervise children
-
damage caused by the attendee

4. SUPERVISION OF CHILDREN
4.1 Children must be actively supervised by a responsible parent or guardian at all times.
4.2 The Organiser accepts no responsibility for supervising minors.

5. MEDIA, PHOTOGRAPHY & PROMOTIONAL USE
5.1 Consent to Photography & Recording
5.1.1 The Event will be photographed, filmed, and recorded.
5.1.2 By attending, the Ticket Holder grants permission for their image, voice, and likeness to be captured.
​
5.2 Use of Media
5.2.1 The Ticket Holder grants the Organiser an irrevocable, perpetual, royalty-free licence to use, publish, modify, broadcast, or distribute this media for:
-
advertising
-
social media
-
website content
-
print media
-
promotional materials
without further consent or compensation.
​
5.3 Opt-Out
5.3.1 Attendees who do not wish to be photographed must notify staff upon entry; however, full exclusion cannot be guaranteed in a public event environment.
6. TICKET VALIDITY & MISUSE
6.1 Tickets must not be resold, duplicated, or altered.
6.2 Fraudulent, void, cancelled, or duplicated tickets may result in refused entry without refund.

7. EVENT RIGHTS & OPERATIONAL AUTHORITY
7.1 The Organiser retains full authority to:
-
modify or close sections of the Event
-
restrict entry to certain areas
-
determine capacity limits
-
manage crowd flow and safety
-
suspend rides or attractions
-
remove unsafe equipment or persons
7.2 All operational decisions made by the Organiser are final.

8. GOVERNING LAW
8.1 These Terms are governed by the laws of Victoria, Australia.
8.2 Any disputes shall be resolved in the relevant Victorian jurisdiction.
9. ACCEPTANCE OF TERMS
9.1 Purchase or use of a ticket signifies full acceptance of these legally binding Terms & Conditions.
